A utility model is a a shape, structure, or combination of an outcome

that is derived with improvement from an invention already invented by an inventor for more convenient and appropriate use.

Differences with Patents

  • Subject of Protection
    An application for a patent may be filed and registered, regardless of whether the subject of the invention is related to a good or a method. However, an application for a utility model is limited only to a shape or a structure of a good, or to a combination of both the shape and the structure of the good, and methods, materials, or processes are excluded from registration. 
  • Use of Rights
    Patent rights are granted and registered after a substantive evaluation by an examiner, thereby giving an inventor the rights at the time of the registration to exclude and prohibit an execution of other person or entity, and thus the patent rights are provided with higher legal stability. Meanwhile, utility model rights are not provided with substantive examination and merely grant the utility model after checking that utility model applications comply with formalities, and thus the utility model may be effective for the inventions having shorter lifecycle and sensitive to trends.
Expiration of
Utility Model Rights

While patent rights are granted for 20 years, starting from the date on which the patent application is filed, utility model rights are granted for 10 years, starting from the date on which the utility model application was filed.
